Prentice Internet has a
responsibility to protect each of our clients and provide the best service possible.
The Prentice Internet customer is expected to have a basic knowledge of how the Internet
functions, the types of use which are generally acceptable on the Internet, and the types
of use which are to be avoided. Prentice Internet offers server space only and has
nothing to do whatsoever with your access to reach our servers or the speeds at which your
material takes to upload or download. It is expected that the Prentice Internet
customer have a computer and possess the technical ability of using File Transfer Protocol
or FrontPage to administer their site. Our service is strictly "self
service" meaning that you or someone you know has the ability to upload and manage
web sites. The following guidelines were designed to ensure these services and to guide
you in using our service taking into consideration the other customers on our servers
while conforming to our network environment.
CONTENT
All services provided by Prentice Internet may be
used for lawful purposes only. Transmission, storage, or presentation of any
information, data or material in violation of any United States Federal, State, or City
law is prohibited. This includes, but is not limited to: copyrighted material,
material we judge to be threatening or obscene, or material protected by trade secrets and
other statutes, violation of U.S. export restrictions, harassment, fraud, trafficking of
obscene material, drug dealing, and other illegal activities.
NOTE: Pornography and sex-related merchandising is
prohibited. This includes sites that may infer sexual content, or links to adult
content elsewhere. This is also true for sites that promote any illegal activity or
content that may be damaging to our servers or any other server on the Internet.
Links to such materials are also prohibited. A few examples of non-acceptable
content or links are:
pirated software
hacker's programs or archives
warez sites
mp3 archives (legal or illegal - they cause resource problems)
sites offering free web-space (they cause resource problems)
Prentice Internet will be the sole arbiter as to
what constitutes a violation of this provision.
SERVER RESOURCES
Any web site that uses a high amount of server resources (such
as, but not limited to, CPU time, memory usage, and network resources) will be given an
option of either paying extra (which depends on the resource needed) or reducing the
resource used to an acceptable level. Prentice Internet shall be the sole arbiter of what
is considered to be a high server usage level.
All web hosting accounts come with a limit of 5000 files per
account. Each block of 5000 files after the initial 5000 will be charged extra.
CHAT ROOMS
Prentice Internet does not allow clients to install
their own chat rooms. Chat rooms tend to be a large system hog and we cannot permit
it as an account option. Prentice Internet does provide Java chat rooms for free or
a small extra fee that should meet most users' needs and run without hindering the
performance of the servers. Non-Java chat rooms (cgi or perl based) are not allowed.
BACKGROUND RUNNING PROGRAMS AND CRON
Prentice Internet does not allow programs to run in
the background. We may permit cron jobs depending on the need.
IRC
Prentice Internet does not allow IRC or IRC bots.
SUB-DOMAINS (THIRD LEVEL DOMAINS)
Prentice Internet does not permit free, unlimited
third level domains or sub-domains. We do not offer DNS entry changes to allow this
feature. We do however, provide sub-domain/third level domains with a unique ip
numbers. Regular account pricing applies.
MAJORDOMO LISTS
Our free majordomo list (1 per domain) generally
have a limit of 100 subscribers. Larger lists are subject to additional pricing.
MAIL CONFIGURATIONS
Prentice Internet supports email connectivity to
our servers directly. This means you specify pop3 and smtp server names in your
email client to connect to us directly to receive email on behalf of your domain.
Any requests for MX record changes to support any other configuration will result in
additional charges.
FOREIGN DOMAIN REGISTRATIONS
Prentice Internet will host any domain from
any foreign registry however the user is responsible for the registration of any name not
a .com, .org, .net, or .edu domain. An .edu domain is for accredited, degree
granting educational institutions. EDU requests (if you feel you warrant an .edu
domain) are not guaranteed by Prentice Internet and if not approved by the InterNIC you
may be forced to obtain an .org domain.
NET ABUSE
The sending of commercial advertising through email
(AKA spamming) from a Prentice Internet server, referring to an URL on a Prentice Internet
server, or using an email address that is maintained on a Prentice Internet server
is STRICTLY PROHIBITED. This includes but is not limited to activities such as using a
non-existent email return address on a commercial solicitation, allowing spamming by third
parties to promote a web site hosted by Prentice Internet, trolling (posting outrageous
messages to generate numerous responses), mail bombing (sending multiple messages without
significant new content to the same user), subscribing someone else to a mailing list
without that person's permission, cross posting articles to any newsgroup without their
permission, and commercial advertisements. In general, any kind of commercial
advertising of your account in areas on the Internet not intended for such purposes is
prohibited. Local government laws construed as protecting this practice do not
apply. If you are found to have spammed, then we will immediately, without warning,
terminate your account with no refund. In addition, we will impose a $300 penalty for each
spam policy violation. We reserve the right to refuse or cancel service to known spammers.
Lastly, we reserve the right to determine what violates this policy.
Complaints about violators of our policies should
be referred to abuse@prentice-internet.com.
Each complaint will be fully investigated. Prentice Internet reserves the right to
fully investigate any reported violations and to determine the proper consequences.
SERVER ABUSE
Any attempts to undermine or cause harm to a
Prentice Internet server or using an email address that is maintained on a Prentice
Internet machine is STRICTLY prohibited. We reserve the right to delete prohibited
content no questions asked and/or delete/deactivate any script (even scripts we
preinstall) if it is used to such an extent that it poses a threat to the performance of
our network. IP numbers assigned to your domain must be resolving to our name server.
We will remove IP numbers not showing our name servers without refund.
SOFTWARE DISTRIBUTION
Prentice Internet's hosting accounts are not to be used for the purposes of distributing
software and multimedia products. If you wish to distribute software and/or
multimedia files, please contact sales@prentice-internet.com
for special arrangements.
MULTIMEDIA FILES
Multimedia files are defined as any graphics, audio, and video
files. Prentice Internet accounts are not to be used for the purposes of distributing and
storing unusual amount of multimedia files. Any web site whose disk space usage for
storing the multimedia files exceed 70% of its total usage, either in terms of total size
or number of files, will be deemed to be using unusual amount of multimedia files.
Accounts with streaming Real Audio/Video are limited to 30 megs of Real Audio/Video
content.
DATABASE
Accounts with mSQL are limited to 15 megs of database storage.
FILE RESTORES
The tape back-up system is in place primarily as a disaster
recover system in case of a server crash or some similar catastrophe. As an added service,
we do provide restoration of customer files when requested but it is not a priority.
We charge $300.00 per incident to perform backup recoveries. Customer
understands that occasionally backups may even prove to be defective and use of our
service is always at the customer's own risk. Customers are greatly encouraged to
keep a backup copy of their web site at all times. Restores may not be the
most recent copy available and/or certain situations may make a backup impossible to
retrieve.
INDEMNIFICATION
Customer agrees that it shall defend, indemnify,
save and hold Prentice Internet harmless from any and all demands, liabilities, losses,
costs and claims, including reasonable attorney's fees asserted against Prentice Internet,
its agents, its customers, officers and employees, that may arise or result from any
service provided or performed or agreed to be performed or any product sold by customer,
it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless
Prentice Internet against liabilities arising out of; (1) any injury to person or property
caused by any products sold or otherwise distributed in connection with Prentice
Internet's servers; (2) any material supplied by customer infringing or allegedly
infringing on the proprietary rights of a third party and (3) copyright infringement. This
means that if we are sued because of activities of the customer that violate any law, the
customer will pay any damages awarded against us, plus costs and reasonable attorneys'
fees.
DISCLAIMER
Prentice Internet will not be responsible for any
damages your business may suffer for any reason. Prentice Internet disclaims any warranty
or merchantability or fitness for a particular purpose. This includes loss of data
resulting from delays, and any and all service interruptions caused by Prentice Internet
and its employees. Customer understands the Internet itself can be volatile and no one
entity can guarantee your site will always be available. If a failure for your web site to
be online is within our control, Prentice Internet will issue a credit in accordance with
your current pricing for the days affected. In no event will Prentice Internet provide
credits for a time period of less than 48 hours or provide credits for downtime for
suspended accounts. Prentice Internet will be the sole arbiter of what is determined to be
within our control. In the event that any service provided by Prentice Internet results in
downtime due to fault of Prentice Internet or for any other reasons, Prentice Internet's
liability shall be limited to the refund of the monies Customer paid to Prentice Internet.
Customer expressly disclaims and waives the right to any additional damages including,
without limitation, direct, consequential, punitive, or any other kind of damages.
Any sub-networks/resellers of Prentice Internet
must adhere to the above policies. The failure to meet or follow any of the above
guidelines are grounds for immediate account deactivation. We reserve the right to
delete any account without prior notice and to refuse service to anyone.
GOVERNING LAW
This Agreement shall be governed by the laws of the
State of Nevada and Customer further consents to jurisdiction by the state and federal
courts sitting in the State of Nevada.
SEVERABILITY
If any provision of this Agreement is held invalid
or unenforceable by any court of final jurisdiction, it is the intent of the parties that
all other provisions of this Agreement be construed to remain fully valid, enforceable and
binding on the parties.
MODIFICATION
This Agreement constitutes the complete and
exclusive agreement between Prentice Internet and Customer with respect to the subject
matter hereof, and supersedes all prior oral or written understandings, communications or
agreements not specifically incorporated herein. This Agreement may not be modified by the
customer except in a writing duly signed by an authorized representative of Prentice
Internet and Customer. Prentice Internet reserves the right to add, delete, or modify any
provision of our policies at any time without notice. |
